By accessing or using the O-Chat Platform, including our Web Dashboard (https://dashboard.o-chat.live), multi-website chat widgets, embedded scripts, and the O-Chat Android Mobile Application, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you may not access or use our services.

To use O-Chat services as a business owner or merchant, you must create an account:

• You agree to provide accurate, current, and complete registration information during sign-up.
• You are responsible for maintaining the confidentiality of your account credentials and login tokens.
• You are solely responsible for all activities, chat sessional threads, and user permissions configured under your account.
• You must notify us immediately at support@o-chat.live if you suspect unauthorized access or security breach.

You agree NOT to use the O-Chat platform or Android Mobile Application for any prohibited activities, including:

• Transmitting unsolicited promotional messages (SPAM), deceptive phish links, or fraudulent communications to website visitors.
• Transmitting malicious code, computer viruses, Trojan horses, keyloggers, or unauthorized web scrapers.
• Harassing, abusing, threatening, or impersonating any individual, agent, or organization.
• Engaging in illegal activities or violating any local, national, or international data privacy laws.

O-Chat offers tiered subscription packages (Starter, Pro, Enterprise) billed in BDT (Bangladeshi Taka) on a monthly or annual basis:

• Feature Entitlements: Each package defines usage limits, such as maximum allowed chat widgets, agents per widget, WebRTC voice/video calls, and automated popup configurations.
• Billing & Gateway: Payments are securely processed via integrated SSL payment gateways (OraclePay). All fees are non-refundable unless required by applicable consumer laws.
• Package Renewal & Expiry: Subscription plans auto-expire at the end of their billing cycle unless renewed. Expired accounts will temporarily lose access to premium feature customization until upgraded.

We strive to maintain 99.99% service uptime. However, we do not guarantee uninterrupted or error-free operation. We reserve the right to perform scheduled server maintenance, security upgrades, or feature enhancements. We may modify or discontinue features with prior notice when feasible.

All intellectual property rights in the O-Chat web software, mobile application source code, chat widget scripts, logos, trademarks, and UI designs belong exclusively to O-Chat. Merchants retain ownership of their proprietary customer data and brand logos uploaded to the system.

To the maximum extent permitted by law, O-Chat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, business interruption, or data loss arising out of your use or inability to use our services.

We reserve the right to suspend or terminate your access to O-Chat services immediately and without prior notice if you violate these Terms, engage in illegal conduct, or compromise platform security. You may discontinue using our services at any time by requesting account closure.

These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Bangladesh.
